Our client was indicted in September 2018 in McDowell County Superior Court with Possession of Methamphetamine and being a Habitual Felon. This same client was indicted in November 2018 in Burke County Superior Court with Possession of Methamphetamine and being threatened with a Habitual Felon indictment if he did not take a plea in Burke County and receive an active prison sentence. After Mr. Webster filed a Motion To Suppress evidence in connection with the search of the client's vehicle in McDowell County, all charges were dismissed in May 2019. A similar Motion was filed by Mr. Webster in Burke County that resulted in our client receiving a plea to a misdemeanor charge and a probationary sentence with no jail time in July 2019.
